Authorities: ETX man refuses to put out fire, gets arrested

ANGELINA COUNTY, TX (KTRE) - A deputy with the Angelina County Sheriff's Office used the law to be sure a fire was extinguished in the Diboll area Tuesday afternoon.

Deputy Chris Wade arrested Daniel Leslie Holeman, 47, in order to allow Diboll firefighters to extinguish the fire, according to Lt. Bryan Holley.

Holley said firefighters were dispatched to Louie Cheatham Road because Holeman was burning on his property, a violation of the county ordinance.

"He was burning beside a tree line and it was dangerous and they needed to put it out," Holley said.

Holeman refused to let firefighters on the property to extinguish the fire and Wade arrived on the scene.

"The officer told him they need to put it out and he wouldn't let them," Holley said. "So the officer made the decision to make the arrest."

A violation of a burn ban is a Class C misdemeanor, which allows law enforcement the option to either write a citation or make an arrest.

"If they're cooperative, we'll just write a citation, maybe even just a warning," Holley said.
