GREGG COUNTY, TX (KLTV) - The Department of Public Safety will be filing Criminally Negligent Homicide charges against a driver who caused a fatality accident in Gregg County over the weekend.
The accident happened on Highway 31 just over the Smith County line where a woman swerved to miss an SUV waiting to turn. She clipped the SUV and collided with a vehicle driven by JW Garrett of Longview. He died at the scene. Four others were hospitalized including Garrett's wife, Betty, and the driver who caused the wreck.
Betty Garrett is undergoing a second surgery to correct injuries sustained from the seat belt. The other driver is suffering from multiple broken bones below her waist.
The Garret family doesn't want the charges filed, but since it's a traffic accident, not a civil case, charges will be filed by DPS.
The Garrett's Daughter tells KLTV a family member's car was broken into last night while staying at JW and Betty's home in Longview. Among the items taken was a camera which had the some of the last pictures taken JW Garrett before the tragic accident.
