LUFKIN, TX (KTRE) - A Lufkin man with a mental disability accused of sexually assaulting another patient at an assisted living residence will be transferred to a maximum security hospital after a judge determined he is incompetent to face criminal charges.
Albert Borjas Jr., 31, was arrested in January after an investigation by the Department of Mental Health and Mental Retardation.
According an arrest warrant affidavit, a staff member at a St. Giles facility observed the victim on Sunday and asked what happened to him. He replied that Borjas sexually assaulted him.
Det. Paul Jackson stated in the affidavit that he interviewed Borjas, who eventually admitted to the assault.
Borjas will go to the hospital where professionals will attempt to make him competent to stand trial.
A grand jury is scheduled to consider the case for indictment next week.
