WINNSBORO, TX (KTLV) - They pleaded no contest to murder, but now, two East Texas brothers are out of jail on probation.
In a plea bargain, Demarcus Hearn and Ty Evans received 10 years probation for their involvement in a drive-by shooting that killed 24-year old Anna Marie Moore.
Moore was shot in the back of the head in front of her small children.
Taylor Moore, Anna's brother-in law, is realizing he may see Ty Evans and Demarcus Hearn around town.
For two years, they were in jail, but now, they are out.
"I just wish more would have been done and for them to be walking away with ten years probation for committing murder. That just blows me away," Taylor expressed.
Evans was tried twice, both ending in mistrials.
This month, Hearn was expected to go to trial for the first time.
Considering the outcome of the previous trials, the Wood County District Attorney says he offered to make a deal---to close the case.
Evans' attorney says there were gaps in the investigation---enough to create doubt.
Taylor says it's hard to feel closure when no one is locked up for Anna Marie's murder.
The Wood County DA says if Hearn or Evans break their terms of probation, they could receive up to life in prison.
