Truvia declared unfit to proceed

TYLER, TX (KLTV) – The case of Byron Truvia, the 17-year-old accused of stabbing a John Tyler teacher, was back before a judge on Wednesday.

State prosecutors and the Defense have agreed to send Truvia back to Vernon State Hospital to undergo a mental evaluation for commitment to a mental institution.

Truvia's case will eventually be moved to adult court, because he turns 18 next week. Truvia will still be treated as a juvenile, as the offense occurred when he was 16.

Truvia is accused of killing John Tyler special-education teacher Todd Henry in September 2009.

After he was found unfit to proceed in February, the State requested a forensic psychologist to evaluate Truvia's mental state. That doctor also questioned Byron's mental competency.
