LUFKIN, TX (KTRE) – An Angelina County judge found a Lufkin man guilty of deadly conduct for a two-year old shooting case.
David Mitchell was accused of firing shots in a Lufkin apartment complex in December 2008. Police responded to a shots-fired call at an apartment complex on Dennman Avenue. They say they found Mitchell sitting with a backpack on the porch of one of the apartments.
Witnesses said a gun found inside the bag belonging to Mitchell. His ex-girlfriend told investigators she believed he fired the shots because she wouldn't let him in her apartment.
Wednesday afternoon, Mitchell received a guilty verdict from Judge Paul White after a non-jury trial.
Assistant District Attorney Julie Alston says sentencing will occur after the probation office submits a pre-sentencing report to the court.
