SMITH COUNTY, TX (KLTV) – Patrick "Booger Red" Kelly will have a new attorney when he is tried a second time.
Kelly was the third person convicted in the Mineola child sex ring. That conviction was overturned earlier this year.
Judge Jack Skeen approved Thad Davidson's request to withdraw from Kelly's case.
Davidson cited financial and emotional reasons for his decision.
In his motion Davidson writes, "Although it has been an honor and a privilege to represent Mr. Kelly to fight for him in various ways since 2008 to the current day, it is time for me to leave the fight and for others to step up and defend him. I am emotionally compromised in this case. I am made impoverished because of this case."
A court-appointed attorney will later be named to represent Kelly in his re-trial.
