TYLER, TEXAS (KLTV) - Tyler Police released a statement, Wednesday stating 1-year-old Jeremy Silva died from a torn atrium in his heart, as a result of blunt force trauma to his chest. He'd been left alone with his 4-year-old brother while his mother went to work in Lindale.
The autopsy report also indicated that Jeremy had suffered prior abuse, including several broken ribs and previous bruising to his body.
Investigators obtained an arrest warrant for Capital Murder on Simon Lopez, H/M, 08/05/1984 (26), of Tyler.
Lopez has not been seen since the baby's death. Meanwhile, Lopez's bond was set at $2,000,000 by Judge Jack Skeen. Lopez is the boyfriend to Emma Torres, who lived with her and the children at 114 N. Ross. Torres was arrested, Tuesday and charged with child endangerment.
Police said she left both her children home alone--the 1-year old and a 4-year-old, while the suspect drove her to work.
Police were back at the home, Wednesday looking for Lopez.
"When you got family mourning during the time of Thanksgiving, it just makes for a bad situation," said Sgt. Jerald Riggle with the Tyler Police Department.
We're told Lopez called the dead child's aunt about the child the day he was rushed to the hospital.
We asked if there was any reason to believe Lopez was no longer in East Texas.
"It's possible," said Riggle. "We're thinking he's still in the area, but it's possible he could have fled."
Lopez made it to the KLTV Crimefighters' "wanted board", charged with aggravated assault with a deadly weapon for his involvement in a couple of drive-by shootings and a fight.
"I just really hope they catch him," said one neighbor who wanted to remain anonymous. "I just hope the Lord has mercy on his soul because that baby didn't deserve that."
Lopez is believed to be driving a 1995 Gray, Lincoln Town Car, 4-door, Texas license plate: BZ9P316.
