SMITH COUNTY, TX (KLTV) - The Smith County D.A.'s Office filed a response to defense attorneys seeking to remove Judge Jack Skeen from presiding over the Mineola swingers club trial of Booger Red Kelly.
The state says, besides not being made in a timely manner, Defense Attorney Thad Davidson has failed to establish a reason to remove Skeen from the case. In court papers filed Monday, the D.A.'s office says Davidson is engaged in a personal vendetta against the judge.
Kelly was originally sentenced to life in prison for his alleged role in the swingers club sex ring.
He has been waiting for a retrial ever since an appeals court overturned his conviction.
Davidson has filed a complaint against Judge Skeen with the State Commission on Judicial Conduct.
