Deputies: Sex offender not in compliance, arrested

TITUS COUNTY, TX (KLTV) - Released by the Titus County Sheriff's Department:

TITUS COUNTY, TX - In the month of September 2010, Titus County Deputies have been conducting compliance checks on registered sex offenders located within Titus County, Texas.  Titus County Sheriff's Office do these compliance checks regularly throughout the year to verify the information required under Chapter 62 of the Texas Code of Criminal Procedure and for the safety of the citizens of Titus County.  These requirements include annual, ninety days, or thirty day periodic verification depending on the risk level assigned by the Texas Department of Public Safety.  These offenders must notify law enforcement 7 days prior to any move and must notify the jurisdiction they are moving to not later than the 7th day after changing address.  Sex Offenders must also report status changes including work location, educational status, and physical health including hospitalization.

On the 10th day of September 2010, Titus County Deputies conducted a compliance check on Roman Bernabe Jr. being he did not follow through with his annual verification requirements.  Roman Bernabe Jr. was found to be out of compliance and deputies questioned him at his residence located at 6493 Highway 67 East Cookville, Texas.  Through the questioning, deputies also found Roman Bernabe Jr. had changed jobs without notifying the Sheriff's Office as required.  This offense is a violation of the Texas Code of Criminal Procedure Chapter 62.102 Failure to Comply with Registration Requirements, a felony of the third degree punishable by imprisonment in the Texas Department of Criminal Justice for any term not more than 10 years or less than 2 years in addition to imprisonment, an individual adjudged guilty of a felony of the third degree may be punished by a fine not to exceed $10,000.

Titus County Deputies arrested Roman Bernabe Jr. for this violation and booked him into the Titus County Jail.  Court documents indicate that the victim of Roman Bernabe Jr.'s crime was a 15 year old female.
