Booger Red Kelly could await trial free from cell

TYLER, TX (KLTV) - Patrick "Booger Red" Kelly could soon be released from prison as he awaits a new trial.

A motion for bail has been filed by Kelly's attorney that would allow him to leave the Tyler jail he has lived in for three years, if he posted a $25,000 bond.

Last week, an appeals court overturned Kelly's conviction for his role in the child sex ring.

The request that was filed Monday says, "The court has reviewed the appellate record carefully. He is married with a son. He has employable skills in demand and a good work record. He is not a flight risk. Kelly's retrial is likely to be delayed for at least another year. A $25,000 personal recognizance bond is appropriate."
