Deputy sentenced for assaulting murder suspect

TYLER, TX (KLTV) - A former East Texas sheriff's deputy received 10 years probation on a charge of assault with a deadly weapon.

Terry Lindsey pleaded guilty in Smith County Court Tuesday to hitting Joshua Barnes, who is accused of fatally stabbing Brandon Lee at a party at Lindsey's house in December of 2009.

Terry Lindsey was off duty at the time.

During the incident, then-Deputy Lindsey hit Barnes with a rifle, handgun, handcuffs, and a rake.

Lindsey was fired from the Smith County Sheriffs Department after his arrest.

Attorneys for Joshua Barnes, who is still awaiting trial on murder charges, filed a motion to refuse the plea agreement for Terry Lindsey, but that motion was rejected.
