Court of Appeals says Truvia to proceed without diagnostic exam

TYLER, TX (KLTV) - The trial of the student accused of stabbing John Tyler teacher Todd Henry may now be a little closer to leaving the juvenile court.

Saturday, the court of appeals issued an opinion on a key factor in the case of Byron Truvia. The request for a complete diagnostic test of Truvia has been denied. The appeals court now allows the juvenile court to decide whether or not Truvia will be tried as an adult.

Truvia's attorney Jim Huggler says despite the trial now continuing without one of its key components, there are still options before Truvia's case leaves juvenile court.
