TYLER, TX (KLTV) - TYLER, TX (KLTV) - Byron Truvia is mentally fit to stand trial. State mental health experts completed their evaluation, late last month. They say the teenager is mentally retarded, but fit to proceed with the case.
Truvia is accused of stabbing a John Tyler High School teacher to death, last September.
The mental evaluation will now help the court decide whether the young man should be tried as an adult.
"Appellate courts have called transferring a juvenile to adult court a juvenile death penalty," said Jim Huggler, Truvia's attorney. "It's the most serious thing that can happen in the juvenile system...and the court has not had anyone look at those issues...because they haven't been able to."
The court could also decide whether Truvia will undergo another, separate evaluation. That one would be done to determine whether Truvia should be in the juvenile, or adult system.
