Hearing held for Smith County constable

SMITH COUNTY, TX (KLTV) - An administrative law judge is expected to hand down a decision on whether or not Smith County Constable Henry Jackson, Pct. 1, gets to keep his peace officer's license.

The Texas Commission on Law Enforcement Officers Standards and Education (TCLEOSE) says the State Board of Administrative Hearings held a hearing, Thursday.

Last year, TCLEOSE announced it was seeking to revoke, or suspend Jackson's licence.

The hearing stems from Jackson's May 2008 arrest, as well as indictments on charges of tampering with government documents and official oppression.

In August of 2008, Jackson pleaded guilty to a misdemeanor tampering charge and a charge of assault.  He was sentenced to probation.

Even if Jackson's license is revoked, he could continue to serve as constable because he was elected to the position.

But TCLEOSE representative said the attorney general's office would be notified that Jackson no longer has a peace officer's license, and TCLEOSE would then request he be removed from office.

The attorney general's office would then have to get a district judge to remove Jackson from office.

We contacted Constable Henry Jackson for a comment on the hearing. He declined to give one.
