Fatal crash, man could face DWI charges

GLADEWATER, TX (KLTV) - A Gladewater man who was involved in a fatal weekend accident could face intoxicated manslaughter charges.

Benjamin Capps turned himself in Wednesday morning, on a DWI warrant for an offense from last August. Police say that was his third DWI offense.

White Oak police say on Saturday, Capps hit another vehicle head-on, killing John Pitner, 74, of Lindale.

Capps' DWI arrest had nothing to do with Saturday's wreck, but charges in the accident are pending.

"We did take blood from Mr. Capps the day of the accident when he got transported to the hospital," said Chief Terry Roach, with White Oak police. "If the blood results come back that he was impaired, then yes, intoxicated manslaughter charges could be filed against him."

Police say if Capps is charged with intoxicated manslaughter he could face a second degree felony and face up to 20 years in prison.
