"You sank my giant cowboy hat!!!"

TYLER, TX (KLTV) - They shut their doors more than six months ago, courtesy of a sinkhole. Now, the owners of Kickerz Coffee say they hope to fix the problem in a courtroom.

The decision came after owners had engineers look at the nearby ravine, cut deeper and deeper by water drainage from area businesses, including Walmart. The lone ranger hat location is now vacant and has been declared a safety hazard.

"We hired experts that have absolutely found Walmart put more water through the pipe that goes underneath the Loop and terminates on my property," said Valerie Smith, owner. "We just cannot afford to fix it again and ultimately this property is unsafe."

The Smiths spent close to half a million dollars on repairs to fix the sinkhole. They said they hope to eventually reopen the stand if and when it's declared safe.
