East Texas woman allegedly shot by her father

HENDERSON COUNTY (Henderson County Sherriff's Office)- On Saturday, June 27,2009 at approximately 10:45 pm, Deputies Richard Miller, Ronny Snow and Josh Rickman along with District Attorney's Investigator Baldemar Quintanilla responded to a shooting on Kokomo St, in the Cherokee Shores subdivision. Officers located Nicole Montana, who had been shot by her father Gary Payne.

Investigator Bryan Tower and Henderson County SO Command Staff were called to the scene. Investigators learned the following: an argument between Montano and Payne had taken place and escalated, Payne left his daughter's residence and went to his residence next door. Payne returned with a 12 gauge shotgun and began firing towards Nicole, striking her in the leg and foot.

Sheriff Nutt called out the HCSO Tactical Team. The tactical team made entry into the victim's house and located the suspect inside. He was taken into custody without incident.

The victim was transported to ETMC in Gun Barrel City and then to ETMC Tyler via helicopter. Gary Wayne Payne was arrested and booked for Aggravated Assault with A Deadly Weapon. Payne is currently being held in the Henderson County Detention Center under a $75,000 bond set by Justice of the Peace Pct 4, Sue Tarrant.

At the time of this release, the victim has been released from the hospital.
