NEW YORK DEFENDS POLICY BLOCKING CHURCHES FROM SCHOOL RENTALS

A lawyer for New York City has told a federal appeals court that churches will move permanently into public schools if a Bronx church wins its eight-year fight to rent a middle school for services. City lawyer Jane Gordon argued that a federal judge went too far in a June decision that found that, under U-S Supreme Court precedent, the Bronx Household of Faith can use the school. Such school rentals are commonplace in many parts of the nation. And the church's attorney -- backed by federal civil rights lawyers -- contended that since the Constitution "protects against government limiting speech," it would be illegal to bar a religious group when the city allows a wide spectrum of other activities in schools.
