Group wants to renew lawsuit against appeals judge

Associated Press - November 5, 2009 1:25 PM ET

AUSTIN, Texas (AP) - A state civil rights group wants to reopen a federal lawsuit against the presiding judge of the state's highest criminal court.

Judge Sharon Keller of the Texas Court of Criminal Appeals had refused to keep the court open after normal hours for lawyers trying to stop an execution in 2007.

Lawyers for the daughter of Michael Richard (rih-SHAHRD') contend in a Thursday filing that Keller misled the federal court when the original lawsuit was dismissed last year.

The lawyers for the Texas Civil Rights Project are seeking unspecified damages in the wrongful death suit.

Keller is awaiting a ruling from a state judicial misconduct hearing earlier this year.
