Milam released from jail because of overcrowding issues, say jail officials

180 days in jail - that's what a Rusk County Judge ordered for 18 year old Blaine Keith Milam back in August after he pleaded guilty to aggravated sexual assault of a child. Milam, along with 18 year old Jessica Carson, are accused of beating to death Jessica's 13 month old daughter.

KLTV 7 News learned that Milam did not serve his entire sentence. Rusk County Jail officials say Milam was put on the work release program because the jail was just too crowded.

Then, on October 30, they released him to a psychiatric facility for treatment. Jail officials wouldn't tell us when he was released from that facility because of privacy laws.

Jail officials tell us that once Milam got treatment, he was released to his family and should have started serving his sentence - but didn't. They say within a matter of time a warrant would have been issued for his arrest.

"When somebody is sentenced to jail time...county jail time is a condition of probation. I do expect, it's been my experience that they serve that full amount of jail time at the beginning of that sentence and that it's served day for day," said Michael Jimerson, the Rusk County District Attorney.

Just to give you a recap - Thursday, we reported that KLTV 7 was the first to alert Rusk County Sheriff's Department that Milam was indeed a registered sex offender, and that Longview Police had Milam registered in Gregg County at a former address.
