Debate over National Day of Prayer constitutionality continues

TYLER, TX (KLTV) - The debate of the constitutionality of the National Day or Prayer continues.

Wednesday, members of the Congressional Prayer Caucus spoke out against the recent ruling of a Wisconsin judge, who ruled that the day violates the Constitution.

The judge's ruling followed a lawsuit filed by an atheist and agnostic group, claiming the day violates separation of church and state.

"What it means to uphold the Constitution is, if you're a district judge, you don't rewrite things...you follow precedent, you follow the law as it is or as the Supreme Court tells you it is," explained Representative Louie Gohmert.

The National Day of Prayer was established by Congress in 1952. In 1998, a federal law required the president to declare the first Thursday in May a National Day of Prayer.
